1. Acceptance of Terms

By accessing this website or engaging the services of EGEN Event Sdn Bhd, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, please do not use our website or services.

These terms apply to all visitors, clients, and any other persons who access or use our website or services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of the revised terms.

2. Our Services

EGEN Event Sdn Bhd provides professional event management services including, but not limited to:

• Corporate event planning and management (annual dinners, conferences, seminars)
• Product launches, brand activations, and experiential marketing
• Team building programmes and corporate retreats
• Virtual and hybrid event production
• Festive celebrations, opening ceremonies, and carnivals
• KOL and influencer management
• Exhibition booth design and construction
• Audio-visual equipment rental and technical support

All services are subject to availability and will be detailed in a formal quotation or proposal provided to the client. The scope of services, deliverables, and timelines will be agreed upon in writing before commencement.

3. Payment Terms

The following payment terms apply to all event management engagements with EGEN Event Sdn Bhd:

1. Booking Confirmation: An event booking is only confirmed upon receipt of the signed quotation/agreement and the required deposit payment.
2. Structured Payments: For larger events, payments may be structured in milestones. A typical structure includes: 30-50% deposit upon confirmation, 30% at the midpoint of planning, and the remaining balance no later than 7 working days before the event date.
3. Final Payment: The full outstanding balance must be settled no later than 7 working days prior to the event date, unless otherwise agreed in writing.
4. Additional Costs: Any additional services, changes, or extras requested after the initial quotation will be billed separately and must be approved by the client in writing.
5. Late Payment: Late payments may incur an administrative charge of 1.5% per month on the outstanding amount. EGEN Event reserves the right to suspend services if payments are significantly overdue.
6. Payment Methods: We accept bank transfers, cheques, and online payments. All payments should be made in Malaysian Ringgit (MYR) unless otherwise agreed.

4. Cancellation & Postponement

We understand that plans may change. The following cancellation terms apply:

• More than 60 days before event: Full deposit refund minus a 10% administrative fee.
• 30 to 60 days before event: 50% of the deposit will be refunded.
• Less than 30 days before event: The full deposit is non-refundable, as costs for venue bookings, vendor commitments, and materials will have been incurred.
• Postponement: Events may be postponed to an alternative date within 6 months of the original date, subject to availability and any additional costs from venues or vendors.
• Force Majeure: In the event of circumstances beyond reasonable control (natural disasters, pandemics, government directives), both parties will work together in good faith to reschedule or adjust arrangements.

All cancellation requests must be submitted in writing via email. Verbal cancellations will not be accepted.

5. Limitation of Liability

EGEN Event Sdn Bhd strives to deliver every event to the highest professional standards. However, our liability is limited as follows:

• Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific event in question.
• We shall not be liable for any indirect, incidental, consequential, or special damages, including loss of revenue, profits, or business opportunities.
• We are not responsible for the actions, performance, or failures of third-party vendors, venues, or suppliers, though we exercise due diligence in their selection.
• We are not liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, utility failures, or government restrictions.
• The website content is provided "as is" without warranties of any kind, either express or implied.

6. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, videos, and design elements, is the property of EGEN Event Sdn Bhd and is protected by Malaysian and international copyright laws.

• You may not reproduce, distribute, modify, or republish any content from this website without our prior written consent.
• Event concepts, proposals, and creative materials developed by EGEN Event remain our intellectual property until full payment is received and ownership is formally transferred as agreed.
• Photographs and videos captured during events may be used by EGEN Event for portfolio and marketing purposes, unless otherwise agreed in writing with the client.
• Client logos, trademarks, and brand materials remain the property of the respective clients and are used only with permission for event-related purposes.

7. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

In the event of any dispute, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, either party may refer the matter to mediation before pursuing legal proceedings.
